Waiver of Probate Bonds

Waiver of Probate Bonds are issued to transfer ownership of bonds, certificates, mutual funds, investment accounts, etc., from the deceased's name into the estate and the estate is not applying for probate or Letters of Administration.

In lieu of having the estate probated, the financial institution issuing company, etc. (Obligee), will request a Waiver of Probate Bond. The bond provides financial protection to the Obligee in the event the estate is not entitled to the instruments indicated in the Waiver of Probate Bond.
